Kim Osorio Verdict Victory · by David Donald

In case you didn’t see this, Peter Carlson of the Washington Post writes:


After a tumultuous two-week trial, Kimberly Osorio, a former editor in chief of the Source magazine, won a workplace lawsuit against the popular hip-hop monthly, and a Manhattan jury awarded her $15.5 million.

“This is a victory for women in hip-hop,” Osorio told the hip-hop Web site SOHH.com after the verdict Monday night. “I stood up and I won.”

Ignoring Osorio’s obnoxious personality and rapper-like tendency to make ridiculous, exaggerated statements, the jury found Osorio was fired in retaliation for complaining about discrimination and sexual harassment and also found that Benzino defamed her after she was fired.

Also:

During the trial in U.S. District Court, Osorio’s attorney, Kenneth Thompson, told Judge Jed S. Rakoff that Scott—who is also a professional rapper known as Benzino—shouted “Coward! Chump! Uncle Tom!” at him as he walked to the men’s room during a recess. Scott denied the charge. The judge gave Scott the choice of staying in the courtroom or being escorted out of the building by a marshal.

I’m as happy as anyone to see the Source lose a large judgment. I’m also as happy as anyone about the likelihood that the judgment will hopefully never make its way into Osorio’s hot little hands because:

  • wtf $15.5M is huge and may very well be reduced on appeal
  • Last thing I heard the Source was in some type of bankruptcy or something. At OhWord we care way too little/we’re way too negligent to bother checking up on this, or the vaguely remembered possibility that the Source was recently bought, but the point is
  • The Source is looking like it’s judgment-proof right now. How is her lawyer going to collect?

  1. I’m not sure if it was Kim but when I was in H-Town one of the local hip-hop stations had a former Source employee on the air and she played a voice mail left by Benzino on her phone. Between the parts that WEREN’T bleeped out he was calling her a faggot, a dyke, and a stuck up bitch. Real class act. The Source has fallen a long way since the days when I used to subscribe (earliest covers I remember were Heavy D and 3rd Bass) and I remember the official day they fell off was the entire editorial staff walking out in protest over Benzino getting a free one page editorial plugging an Almighty RSO album. Whether the judgment is collected or not, whether Kim might actually be a loudmouth or not, it’s hard to say they haven’t had this coming for a long time.
